ਕੈਨੇਡਾ ਦੀ ਸੁਪਰੀਮ ਕੋਰਟ ਦਾ ਕਹਿਣਾ ਹੈ ਕਿ ਕੰਡੋਮ ਨਾਲ ਸੈਕਸ, ਬਿਨਾਂ ਕੰਡੋਮ ਸੈਕਸ ਕਰਨ ਨਾਲੋਂ ਵੱਖਰੀ ਸਰੀਰਕ ਕਿਰਿਆ ਹੈ, ਅਤੇ ਕੰਡੋਮ ਦੀ ਵਰਤੋਂ ਜਿਨਸੀ ਸ਼ੋਸ਼ਣ ਕਾਨੂੰਨ ਦੇ ਤਹਿਤ ਸਹਿਮਤੀ ਦੀ ਸ਼ਰਤ ਹੋ ਸਕਦੀ ਹੈ।

Sex with a condom is a different physical act than sex without one, and that the use of a condom can be a condition of consent under sexual assault law, says the Supreme Court of Canada.

On Friday, the top court says in a decision “no, not without a condom” should not be found to mean “yes, with a condom” in a courtroom.

The court has ordered a new trial in a British Columbia case in which a complainant told a new partner, Ross McKenzie Kirkpatrick, that she would only have sex with him if he wore a condom.

The sexual assault charge against Kirkpatrick was dismissed by a trial judge who found there was no evidence the complainant had not consented to “the sexual activity in question.”
